1. Acceptance of Terms

By accessing and using VideoChatCouple ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't accept these Terms, don't use the Service.

We reserve the right to modify these Terms at any time. Substantial changes will be notified via banner on the site. By continuing to use the Service after changes, you accept the new Terms.

2. Age Requirements

Consequences of violation:

• Immediate permanent ban
• Report to competent authorities (if legally required)
• Immediate deletion of all data

3. Service Description

VideoChatCouple is a random video chat platform that connects anonymous users for real-time video conversations.

3.1 Features

• Random connection with other online users
• Real-time video and audio (peer-to-peer)
• No registration required
• Automatic AI moderation
• Ability to skip to next user

3.2 Limitations

• Service provided "as is" without warranties
• We don't guarantee 24/7 availability (maintenance, updates)
• We don't guarantee connection quality (depends on user network)
• We don't guarantee minimum number of online users

4. Usage Rules

4.1 PROHIBITED Behaviors

• Illegal content: Child pornography, violence, terrorism, hate speech
• Nudity/explicit sexual content: Even if consensual between adults
• Harassment: Insults, threats, stalking, bullying
• Spam: Advertising, commercial links, phishing
• Impersonation: Pretending to be other people or entities
• Unauthorized recording: Recording video/audio without consent
• Automation: Bots, scripts, automatic scraping
• Ban evasion: Attempting to bypass bans via VPN, proxy, etc.

4.2 ALLOWED Behaviors

• ✅ Respectful conversations between consenting adults
• ✅ Sharing interests, hobbies, opinions (respecting others)
• ✅ Using webcam and microphone for communication
• ✅ Skipping users if not interested in conversation

5. Moderation and Security

5.1 AI Moderation System

We use an artificial intelligence system to automatically detect inappropriate content in real-time. The system can:

• Analyze video frames to detect nudity/explicit content
• Automatically disconnect users who violate rules
• Apply temporary or permanent bans

5.2 User Reports

Every user can report inappropriate behavior via the "Report" button. Reports are reviewed and may lead to:

• Warning
• Temporary ban (24h, 7 days, 30 days)
• Permanent ban
• Report to authorities (for serious illegal content)

5.3 Right to Refuse Service

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion, without notice and without obligation to provide reasons.

6. Privacy and Personal Data

Processing of your personal data is governed by our Privacy Policy. Key points:

• We don't record video or audio from chats
• Conversations are peer-to-peer (don't pass through our servers)
• We only collect necessary technical data (IP, User Agent, timestamp)
• We don't sell your data to third parties

7. Intellectual Property

7.1 Site Content

All site content (logo, design, code, text) is property of VideoChatCouple and protected by copyright. It's prohibited to:

• Copy, modify, distribute source code
• Use logo or brand without authorization
• Create derivative or competitive services using our code

7.2 User Content

We don't claim ownership of content you share during chats. However, you grant VideoChatCouple a limited license to:

• Process data necessary to provide the service
• Use screenshots/anonymous data for technical improvements

8. Limitation of Liability

8.1 No Warranty

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, reliability, or continuous availability

8.2 Limitation of Damages

IN NO EVENT SHALL VideoChatCouple BE LIABLE FOR:

• Direct, indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Behavior of other users (harassment, inappropriate content)
• Service interruptions, bugs, or technical errors
• Security breaches or unauthorized access

8.3 User Responsibility

THE USER IS SOLELY RESPONSIBLE FOR:

• Own behavior and shared content
• Interactions with other users
• Protection of own devices (antivirus, firewall)
• Verification of identity/age of other users (we don't guarantee verification)
• Decision to share personal information (not recommended)

9. Indemnification

You agree to indemnify, defend, and hold harmless VideoChatCouple, its owners, employees, and partners from any claim, damage, loss, liability, and expense (including legal fees) arising from:

• Your violation of these Terms
• Your violation of laws or regulations
• Your violation of third-party rights
• Your improper use of the Service

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by Italian law. Any dispute will be subject to the exclusive jurisdiction of Italian courts.

10.2 Amicable Resolution

Before taking legal action, parties commit to attempting amicable resolution of the dispute through direct negotiation.

11. General Provisions

11.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and VideoChatCouple.

11.2 Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in effect.

11.3 Waiver

Failure to exercise a right by VideoChatCouple doesn't constitute waiver of that right.

11.4 Assignment

You can't assign or transfer these Terms without our written consent. VideoChatCouple can assign these Terms without restrictions.

12. Termination

12.1 Termination by You

You can cease using the Service at any time by simply stopping access to the site.

12.2 Termination by Us

We can terminate or suspend your access immediately, without notice, for any reason, including but not limited to:

• Violation of these Terms
• Inappropriate or illegal behavior
• Requests from competent authorities
• Service cessation

12.3 Effects of Termination

Upon termination:

• Your right to use the Service ceases immediately
• Your data will be deleted according to Privacy Policy
• Provisions that by their nature survive (liability limitations, indemnification) remain in effect
